Terms of Use

These Terms & Conditions (“Terms”) form a binding agreement between you (“you”, “User”) and Medovix LLP (“Medovix”, “we”, “us”), a limited liability partnership registered in India under the Limited Liability Partnership Act, 2008, with its registered office at D-204, Abhimanyu, NL Complex, Dahisar East, Mumbai 400068, Maharashtra, India. They govern your access to and use of the Medovix mobile application and related backend services (collectively, the “Services”). By installing, registering for, or otherwise using the Services, you confirm you have read, understood, and agree to be bound by these Terms.

Not medical advice. Medovix is a personal health-management tool, not a medical device or a substitute for professional care. Nothing in the app — including the Vix AI assistant, reminders, or trivia — is medical advice. In an emergency, call your local emergency number (India: 108 medical, 112 general). Do not rely on the app for emergencies.

1. Nature of the Services

Medovix is a personal health-management application. It helps you record medications, set reminders, track adherence, manage appointments, store report files, view simple analytics, and optionally share access with caregivers you trust. The Services are for personal information management only. They are NOT a medical device, telemedicine service, prescribing platform, diagnostic tool, or substitute for professional healthcare.

3. Eligibility and registration

Medovix is available to Users aged 13 and over. If you are 18 or older you may create and independently operate your own account. If you are between 13 and 17 years old you may register your own account, but the account will remain in a limited, pending state — and we will not process your health data beyond what is necessary to obtain consent — until a parent or legal guardian provides verifiable consent to the processing of your personal data as required by the Digital Personal Data Protection Act, 2023. To obtain that consent, at sign-up you must provide a parent’s or guardian’s email address, or the Medovix ID of a parent/guardian who already holds a Medovix account (from which we will obtain their contact email). We then send that parent/guardian a request to approve or decline. The parent/guardian may approve, decline, or later withdraw consent at any time, which grants or revokes the minor’s access accordingly; they may also elect to have the minor added to their own account as a managed dependent. Alternatively, a parent or guardian may add an under-18 directly as a dependent they manage. We do not knowingly permit registration or use by anyone under 13.

Verifiable parental consent for minors is a legal requirement, not a formality. You confirm that any email address or Medovix ID you provide for a parent/guardian is genuine and belongs to your actual parent or legal guardian. Providing false guardian details, or attempting to bypass the consent process, is a breach of these Terms and may result in suspension of the account.

You confirm that the information you provide at signup (name, date of birth, contact details, health profile) is accurate and complete. You are responsible for all activity that occurs under your account and for keeping your credentials confidential. We may refuse, suspend, or terminate any account that violates these Terms, applicable law, or that poses a risk to other Users.

6. What we store

The Services collect and store, on your behalf: identity (name, email, phone, date of birth, gender, blood group); anthropometric data (height, weight); health profile (self-reported conditions and allergies); medications (name, strength, form, stock, notes, schedules); reminders and dose history; appointments; reports you upload; Vix AI conversations; and operational data (last-seen timestamp, device push token, notification interactions, and private in-app usage analytics). Usage data is private to your account, is used only by us to improve the app and decide which in-app promotions or ads to show you, and is NEVER shared with, or used to build audiences on, any advertiser or ad network. You can turn it off in Profile → Settings. See the Privacy Policy for full detail.

7. Lawful basis and consent

You provide explicit, informed consent for us to collect and process your data by accepting these Terms. You may withdraw consent at any time by deleting your account (see Section 14). Withdrawal terminates the Services’ core features for your account. We process your data only for the purposes described in our Privacy Policy.

8. Where your data is processed

Data is hosted on Supabase Inc., which operates in the United States and other regions. By using the Services you consent to your data being transferred to, processed, and stored in jurisdictions outside India. Vix AI requests are processed by Anthropic PBC (United States); Anthropic does not train its models on your data per their commercial terms. Push notifications are routed through Firebase Cloud Messaging (Google LLC, United States). We do not sell or rent your data to third parties for advertising, profiling, or marketing.

9. Your rights (DPDP Act, 2023)

You have the right to access a copy of your personal data, request correction (or correct it yourself in-app), request deletion of your account and associated data (Profile → Settings → Delete my account, or write to hi@medovix.com), and lodge a complaint with the Data Protection Board of India. We will respond to verifiable rights requests within 30 days.

10. Accuracy of your data

You are SOLELY responsible for the accuracy and completeness of information you enter, including medications and doses. Inaccurate entries can produce inaccurate reminders, incorrect adherence reports, and incorrect caregiver views. Medovix does not verify clinical correctness of user-entered content.

11. Acceptable use

You agree NOT to: store data about another adult without that person’s clear consent; reverse-engineer, decompile, or attempt to extract source code or data of the Services or other Users; use the Services to commit fraud, identity theft, harassment, or any unlawful act; upload content that contains malware, infringes intellectual property, or violates third-party rights; or use the Services in connection with the practice of medicine, telemedicine, or any regulated medical activity.

13. Intellectual property

The “Medovix” name, logo, the look and feel of the Services, our software, and our Health Trivia and Vix AI prompts are owned by Medovix or its licensors. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Services for personal, non-commercial purposes only. Content you upload (reports, notes, medication entries) remains yours; you grant Medovix a worldwide, royalty-free, limited licence to host, display, and process that content solely for the purpose of operating the Services for you and any Caregivers you have authorised.

14. Account deletion

You may delete your account at any time from Profile → Settings → Delete my account. Deletion permanently and irreversibly removes your profile, medications, reminders, dose history, appointments, reports, Vix conversation history, caregiver links, and access codes. Aggregated, non-identifying analytics may be retained. We may suspend or terminate your account for breach of these Terms, fraud, or risk to other Users, with notice where reasonably possible.

15. Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including (without limitation) warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant uninterrupted operation, error-free performance, or that any defect will be corrected. To the maximum extent permitted by law we disclaim all such warranties.

16. Limitation of liability

To the maximum extent permitted by applicable law: we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including (without limitation) loss of profits, loss of data, loss of goodwill, loss of life or limb arising from missed reminders, or any damages arising from your reliance on Vix AI or any other content. Our aggregate liability for any claim arising out of or related to the Services shall not exceed the greater of (i) INR 1,000 or (ii) the total fees you paid us in the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes our liability for fraud, gross negligence, or any other liability that cannot be excluded by law.

17. Indemnity

You agree to indemnify, defend, and hold harmless Medovix, its affiliates, officers, employees, and contractors from any claim, damage, loss, liability, or expense (including reasonable legal fees) arising out of: (a) your use of the Services in breach of these Terms; (b) inaccurate information you provided about yourself or any other person; (c) your violation of any law or third-party right.

18. Changes to these Terms

We may update these Terms from time to time. Where the changes are material, we will notify you within the app or by email at least 14 days before they take effect, and we will require you to re-accept the Terms before continuing to use the Services. Continued use after the effective date constitutes acceptance.

19. Governing law and disputes

These Terms are governed by the laws of India. The courts at Mumbai have exclusive jurisdiction over any dispute arising under or relating to these Terms. Where Indian consumer law mandates an alternative forum or method (e.g., consumer commissions, mediation under the Mediation Act 2023), nothing in this clause overrides those mandatory rights.

Caregiver Terms

A supplement to the Terms above — applies when you use Caregiver mode.

These Caregiver Terms supplement the general Medovix Terms & Conditions. By activating Caregiver mode in your account, or by accepting an access code or a link from a patient, you agree to these Caregiver Terms in addition to any patient-facing Terms applicable to your own account with Medovix.

1. Role and scope

Caregiver mode lets you view, in READ-ONLY form, the categories of health data a patient has made available to you in the app. It does not grant you the ability to edit, add, or delete the patient’s medications, reminders, appointments, reports, or any other entry. Your relationship is solely with the patient(s) you assist. Medovix is the technology provider only — not your employer, agent, or healthcare partner.

2. Authorisation and revocation

You represent and warrant that each patient whose data you access has knowingly approved your access via the in-app linking flow. The patient may revoke your access at any time. If access is revoked, you must stop viewing any of that patient’s data within the Services immediately, and not retain, copy, redistribute, or use any data you have already viewed except as permitted by law or the patient’s express written consent. You may also voluntarily end a link from Profile → Linked Patients; doing so does not authorise you to retain data outside the Services.

3. Confidentiality

All patient health information you access is strictly confidential. You must not disclose, sell, publish, share screenshots of, or use that information for any purpose other than supporting the specific patient’s care, except with the patient’s explicit consent or as required by law. Unauthorised disclosure may expose you to civil and criminal liability under the Digital Personal Data Protection Act, 2023, the Indian Penal Code, and other applicable statutes.

4. No clinical authority

Unless you hold independent legal authority (e.g., legal guardianship, a valid healthcare power of attorney recognised under Indian law), Caregiver mode does NOT authorise you to make medical decisions for the patient. Medovix does not create a clinician–patient relationship between you and the patient, or between you and Medovix, by virtue of these Terms.

5. Accuracy and limitations

The data you see in Caregiver mode reflects what the patient (or others authorised by the patient) entered into the Services. Medovix does not verify clinical accuracy. You are responsible for verifying critical information with the patient and licensed healthcare professionals before acting on it. Reminders, analytics, and Vix AI replies are informational only.

6. Multiple patients

If your subscription tier allows you to link to more than one patient, you must keep each patient’s information strictly separate and use data only for the patient to whom it pertains.

7. Security obligations

Protect your device with a screen lock or biometric authentication. Do not log into your account on shared, public, or untrusted devices. Report any suspected unauthorised access to your account to hi@medovix.com and to the affected patient(s) without undue delay.

8. Prohibited conduct

You agree NOT to: harass, intimidate, or coerce any patient via the Services; attempt to circumvent a patient’s revocation, scrape bulk data, or extract data from the Services other than as a normal Caregiver user; use Caregiver mode for any commercial exploitation of patient information; misrepresent your relationship to a patient when requesting a link; or take any clinical action on the patient’s behalf where you lack independent legal authority.

9. Termination

The patient may revoke your access at any time and for any reason. Medovix may suspend or terminate your Caregiver access for breach of these Terms, fraud, or risk to other Users. Termination does not relieve you of any confidentiality or indemnity obligations you accepted while you had access.

10. Disclaimer and liability

The Services are provided to Caregivers on the same “AS IS” / “AS AVAILABLE” basis as to patients (see § 15 above). Medovix is not liable for disputes between you and any patient, for decisions you make based on data you viewed in the Services, or for any indirect, incidental, special, consequential, or punitive damages. Sections 15 and 16 above apply equally to your Caregiver use.

11. Indemnity

You agree to indemnify, defend, and hold harmless Medovix and its affiliates from any claim arising out of: (a) your breach of these Caregiver Terms; (b) your misuse or unauthorised disclosure of patient data; (c) your misrepresentation of your relationship to any patient.

12. Changes & governing law

We may update these Caregiver Terms; where material, we will notify you in-app at least 14 days before the change takes effect and require re-acceptance. These Caregiver Terms are governed by Indian law, with Mumbai courts and mandatory consumer protections preserved, as in the patient Terms. Contact: hi@medovix.com.
